Terms of Service

These Terms of Service (“Terms”) govern access to and use of IrisTrackR (the “Service”), a medical tracking and aid station management platform for endurance sporting events. IrisTrackR is jointly operated by Cogent Steps, LLC and STRADL LLC (together, “we,” “us,” or “Operators”).
By accessing or using the Service, you agree to these Terms, our Privacy Policy, and—if you receive IrisTrackR text messages—our Messaging Policy. If you do not agree, do not use the Service.
1. The Service
IrisTrackR provides tools for race organizers and medical/operations staff to manage medical encounters, aid stations, documentation, and related event operations. Features may include real-time tracking, aid station management, medical documentation, family reunification workflows, analytics, and operational messaging where enabled for an event.
2. Race-owned data and distribution control
Race organizers (the “Race”) own the event data entered into or generated through IrisTrackR for their event, including participant, emergency-contact, medical, and operational records, subject to applicable law and these Terms. The Race controls how that data is distributed within and for their event operations.
We do not sell Race data. We do not release Race data to third parties for their own marketing or unrelated commercial purposes. We may access or process data only as needed to operate, secure, and support the Service for the Race, and we may disclose information when required to comply with law, regulation, legal process, or governmental request, or to protect the rights, safety, or security of participants, staff, Operators, or the public.
3. Accounts and acceptable use
Race staff and authorized users must:
- Provide accurate information and keep credentials confidential;
- Use the Service only for legitimate event medical and operations purposes;
- Comply with applicable privacy, health, and communications laws;
- Not attempt to disrupt, reverse engineer, or misuse the Service or other users’ data.
We may suspend or terminate access for violations of these Terms or for security, legal, or operational reasons.
4. Text messaging
Where enabled for an event, IrisTrackR may send transactional text messages in connection with race medical and operations workflows. The IrisTrackR Messaging Policy describes who receives messages, how consent is obtained, message frequency, opt-out and help instructions, and related privacy practices.
5. Contact practices
For operational outreach related to participants, IrisTrackR and Race operations focus on contacting the designated emergency contact and requesting that they call into the race operations center, rather than independently disclosing participant medical details to unrelated third parties.
6. Intellectual property
The Service software, branding, documentation, and related materials are owned by the Operators or their licensors. Race data remains owned by the Race as described above. You may not copy, modify, or distribute the Service except as expressly permitted in writing.
7. Disclaimers
The Service is a tools platform for event operations and documentation. It is provided “as is” and “as available.” IrisTrackR is not a substitute for licensed medical judgment, emergency services (including 911), or on-site clinical care. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant uninterrupted or error-free operation.
8. Limitation of liability
To the fullest extent permitted by law, the Operators and their officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from use of the Service. Our aggregate liability for claims relating to the Service will not exceed the fees paid to us for the Service for the event giving rise to the claim (or one hundred U.S. dollars if no fees were paid), except where liability cannot be limited by law.
9. Indemnification
Race organizers and users agree to defend and indemnify the Operators against claims arising from their misuse of the Service, unlawful processing of personal information, inaccurate emergency-contact data or consent, or violation of these Terms, except to the extent caused by the Operators’ willful misconduct.
10. Changes
We may update these Terms from time to time. The “Effective date” above will be revised when changes are posted. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Courts of competent jurisdiction located in Virginia shall have exclusive jurisdiction over disputes arising under these Terms, except where prohibited by law.
